Refugee law faces an unprecedented crisis of identity mainly in Europe, the US and in Australia. Its ideological foundations are questioned and attacked, its legal validity is undermined, it is broadly maligned and ridiculed by powerful ideological groups.
This historical setting forms the backdrop for a crucial rethinking of refugee law. Niraj Nathwani will consider the purpose and theoretical basis of refugee law based on an overview and critique of various theories which have been offered for the existence and purpose of refugee law.
Concluding with a presentation of his own theory which leads to understanding refugee law in a new light and with fresh purpose, Niraj Nathwani hopes to support defenders of refugee law in the future.
